SECTION 22-A. ACCESSIBILITY, DISABILITY AND VULNERABLE USERS POLICY - ANNEX
This document constitutes a specific service annex (the “Annex”) and forms an integral part of the Global Terms & Conditions of Oro Technologies LLC.
In the event of a conflict, the Global Terms & Conditions shall prevail.
ORO operates exclusively as a technology platform provider and does not provide medical transportation, assisted transportation, caregiving services, accessibility supervision, emergency response services, or disability support services.
All transportation and related services available through the Platform are independently performed by third-party providers operating outside the control, supervision, and direction of ORO.
Accessibility-related functionalities are provided solely as optional technological assistance tools intended to improve usability and inclusion, and shall not be interpreted as guarantees of accessibility outcomes, safety conditions, medical support, transportation suitability, or specialized accommodation.
ORO is committed to promoting accessibility, inclusion, and non-discrimination within its Platform, in accordance with applicable laws in the United States, including but not limited to the Americans with Disabilities Act (ADA), as well as other applicable international, federal, state, and local regulations.
This Policy forms an integral part of the Terms and Conditions and must be read in conjunction with all incorporated policies, including safety, voice, and emergency features.
1. ACCESSIBILITY PRINCIPLES, EQUAL ACCESS AND TECHNOLOGICAL LIMITATIONS
ORO is committed to promoting commercially reasonable accessibility, inclusion, and non-discrimination measures within its technological ecosystem in accordance with applicable laws, including the Americans with Disabilities Act (ADA) and other applicable accessibility regulations where legally required.
However, the User expressly acknowledges and agrees that the Platform operates exclusively as a digital intermediary technology service and that accessibility outcomes may vary depending on:

device compatibility;

operating-system limitations;
-
network conditions;
-
third-party infrastructure;
-
driver availability;
-
regional market conditions;
-
user-specific physical, cognitive, linguistic, auditory, visual, or technological circumstances.
ORO does not guarantee that the Platform, voice technologies, accessibility tools, or third-party transportation providers will satisfy every individual accessibility need, disability accommodation, medical condition, or personal assistance requirement.
The Platform and all accessibility-related functionalities are provided on an “AS IS” and “AS AVAILABLE” basis within the inherent limitations of modern mobile technologies and independent third-party service environments.
ORO does not warrant compatibility with all assistive technologies, screen readers, hearing devices, accessibility applications, accessibility peripherals, or third-party accessibility software.
1-A. ACCESSIBILITY-BY-DESIGN AND VOICE-FIRST INCLUSION PHILOSOPHY
ORO was designed under an accessibility-first and voice-first technological philosophy intended to reduce barriers commonly associated with complex mobile applications, excessive screen interaction, and technological dependence.
ORO FOUNDATIONAL ACCESSIBILITY AND DIGITAL INCLUSION OBJECTIVES
ORO was developed based on the principle that access to transportation-related technology should not depend upon advanced technical knowledge, constant screen interaction, or extensive familiarity with mobile applications.
The Company recognizes that many individuals encounter barriers when using modern digital platforms, including elderly users, persons with disabilities, individuals with limited technological literacy, users unfamiliar with smartphones, and users who simply prefer simpler and more intuitive interaction methods.
Accordingly, ORO seeks to reduce unnecessary technological complexity by minimizing dependence on multiple menus, excessive visual navigation, and continuous manual interaction with mobile devices.
The Platform's voice-first architecture was developed to allow Users to access many functionalities through voice-assisted interaction models intended to facilitate greater independence, convenience, and usability.
ORO further recognizes that reducing the need for continuous device manipulation may contribute to a more comfortable user experience and may help Users avoid situations in which they feel compelled to constantly hold, observe, or interact with their devices during service coordination.
The Platform may therefore provide voice-assisted information relating to estimated arrival times, pickup coordination, service-status updates, navigation-related prompts, and communication tools intended to facilitate coordination between Users and independent third-party providers.
ORO believes that effective coordination of pickup locations and meeting points can contribute to operational efficiency, user convenience, and accessibility-oriented service experiences. However, ORO does not guarantee safety outcomes, theft prevention, accident prevention, communication success, accessibility outcomes, transportation outcomes, or successful coordination between parties.
All accessibility-related, communication-related, and voice-enabled functionalities remain optional technological tools only and shall not be interpreted as guarantees of personal safety, supervision, accessibility performance, emergency response, transportation suitability, or risk elimination.
The Platform seeks to promote broader usability for a diverse population of users, including:
elderly individuals;
persons with disabilities;
users with limited technological literacy;
individuals unfamiliar with mobile applications;
users seeking reduced screen interaction during mobility activities;
and users who prefer voice-based interaction models.
To support such objectives, the Platform may incorporate simplified interfaces, voice-command functionality, voice-generated service requests, audio guidance, estimated arrival information, voice-enabled communication tools, accessibility-oriented workflows, and other technologies intended to facilitate independent use.
The Platform may also provide communication mechanisms intended to facilitate coordination between Users and independent Providers regarding pickup locations, meeting points, arrival timing, and trip-related logistics.
However, the User expressly acknowledges that accessibility-oriented design objectives do not constitute guarantees of accessibility outcomes, safety outcomes, technological simplicity, successful communication, independent usability, transportation suitability, or uninterrupted functionality.
Accessibility-related features are supportive technological tools only and shall not be interpreted as medical assistance, caregiving services, transportation supervision, personal protection services, emergency monitoring systems, or guarantees of user independence.
Individual experiences may vary depending on personal circumstances, technological conditions, device capabilities, environmental factors, network quality, language recognition performance, and third-party provider interactions.
2. Independent Nature of Drivers
Users expressly acknowledge that:

Drivers are independent third-party providers
-
ORO does NOT employ, control, supervise, or direct Drivers
ORO further does NOT:

train Drivers for medical assistance;
-
certify accessibility competence;
-
guarantee disability accommodation;
-
supervise physical interactions;
-
provide assisted-care personnel;
-
verify medical qualifications;
-
monitor transportation conditions in real time.
Therefore:
👉 ORO does NOT guarantee that any Driver will:

accept a ride
-
provide physical assistance
-
accommodate specific accessibility needs
-
possess accessibility-compatible vehicles or equipment
NO CONTINUING OBLIGATION TO DEVELOP OR MAINTAIN SPECIFIC ACCESSIBILITY FEATURES
While ORO TECHNOLOGIES LLC may periodically enhance, modify, remove, suspend, replace, redesign, discontinue, or update accessibility-related functionalities, voice technologies, assistive features, communication systems, accessibility workflows, or inclusion-oriented tools, nothing in this Policy shall be interpreted as creating a continuing obligation to maintain any particular accessibility feature, technological capability, operational functionality, design element, communication method, or assistive technology.
Accessibility-related functionalities may evolve over time based upon operational considerations, technological feasibility, legal requirements, product development priorities, commercial factors, security considerations, user feedback, regulatory developments, or other legitimate business considerations.
Users acknowledge that accessibility technologies may change, be modified, or be discontinued without creating liability or entitlement to continued access.
3. USER RESPONSIBILITY FOR ACCESSIBILITY, MEDICAL, MOBILITY AND SPECIAL ASSISTANCE NEEDS
Users requiring:

mobility assistance;

medical supervision;
-
assisted transportation;
-
cognitive support;
-
physical assistance;
-
accessibility accommodation;
-
continuous supervision;
-
specialized transportation conditions;
remain solely and exclusively responsible for:
-
determining whether the Platform is appropriate for their individual circumstances;
-
verifying whether an independent third-party provider can reasonably accommodate their needs;
-
communicating accessibility-related information directly to the independent provider where appropriate;
-
securing any required caregiver, companion, assistant, medical personnel, or specialized transportation provider.
ORO does not:
-
provide caregivers;
-
provide medical supervision;
-
provide transportation attendants;
-
provide assisted-living services;
-
coordinate specialized disability transportation;
-
guarantee accessibility compatibility of vehicles;
-
guarantee physical assistance by Drivers;
-
guarantee supervision of vulnerable individuals.
Users acknowledge that the Platform is not designed for individuals requiring continuous medical observation, specialized transportation licensing, or professional care services.
4. No Medical or Assisted Transport Services
The Platform is NOT designed or intended for:

medical transportation
-
emergency medical services
-
assisted care services
-
transport of individuals requiring professional supervision
Users requiring such services must use appropriately licensed and regulated providers.
5. LIMITATION OF LIABILITY FOR ACCESSIBILITY, DISABILITY AND VULNERABLE USER CLAIMS
To the maximum extent permitted by applicable law, ORO shall not be liable for:

refusal of service by independent Drivers;

inability of a Driver to accommodate specific disabilities or accessibility needs;
-
lack of wheelchair accessibility or specialized equipment;
-
communication limitations;
-
physical assistance limitations;
-
accessibility-related misunderstandings;
-
injuries arising from boarding, exiting, loading, unloading, or transportation activities;
-
acts or omissions of independent third-party providers;
-
medical events occurring during transportation;
-
supervision failures involving vulnerable individuals;
-
service incompatibility with specific accessibility expectations.
The User expressly acknowledges that transportation and mobility activities inherently involve risk, particularly for elderly individuals, persons with disabilities, and users with medical or mobility-related conditions.
Accordingly, Users assume full responsibility for evaluating whether use of the Platform is appropriate for their individual circumstances.
6. Misuse of Accessibility Claims
Any fraudulent, abusive, or misleading use of:

disability claims
-
priority access requests
-
accessibility-related features
may result in:
-
temporary suspension
-
permanent account termination
-
restriction of platform access
-
legal action where applicable
7. Safety and Risk Acknowledgment
Users acknowledge and agree that:

all transportation activities involve inherent risks
-
Drivers operate independently and are not controlled by ORO
-
vehicle conditions and Driver conduct are outside ORO’s direct control
Passengers with disabilities or vulnerabilities:

8. Optional Platform Features
Accessibility-related features, including voice and communication tools:

are provided on an “as-is” and “as-available” basis

may vary by region, device, or availability

are NOT guaranteed to function without interruption or error
8-A. VOICE-FIRST ACCESSIBILITY TECHNOLOGY DISCLAIMER
The Platform may incorporate voice-first interaction systems intended to facilitate accessibility and usability for individuals with limited manual interaction capabilities, elderly users, and persons with disabilities.
The User expressly acknowledges that voice-recognition technologies are inherently probabilistic and subject to technological limitations, including:

speech-recognition inaccuracies;
-
accent interpretation issues;
-
cognitive or linguistic variability;
-
environmental interference;
-
delayed execution;
-
unintended activations;
-
connectivity failures;
-
operating-system restrictions.
Voice-based functionalities do not constitute:

medical monitoring systems;
-
emergency-response systems;
-
supervised accessibility services;
-
disability-care infrastructure;
-
continuous listening systems.
ORO does not guarantee that voice-enabled accessibility features will operate uninterruptedly, accurately, or consistently under all conditions.
To the maximum extent permitted by law, ORO disclaims liability arising from:

failed accessibility interactions;
-
incorrect voice interpretation;
-
unintended system behavior;
-
communication failures;
-
technological limitations associated with voice-based interaction systems.
SECTION 22-A (CONTINUED). ACCESSIBILITY FEATURES AND CONDITIONS

d) Assistive Devices and Equipment
Passengers may travel with:
wheelchairs
walkers
mobility aids
medical equipment
Voice commands, voice-generated requests, speech-based instructions, and voice-enabled interactions initiated through the Platform shall be deemed user-generated actions and may be treated as legally valid and binding instructions to the maximum extent permitted by applicable law, regardless of transcription inaccuracies, interpretation variances, speech-recognition limitations, technological distortions, or automated processing errors.
However:
ORO does NOT guarantee vehicle compatibility
Drivers are NOT obligated to provide physical assistance unless otherwise expressly required by mandatory applicable law.
Any assistance voluntarily provided by a Driver shall be rendered exclusively under the Driver’s independent discretion, responsibility, and judgment, and shall not create any agency, employment, supervision, control, medical-duty, caregiving, or accessibility-service obligation attributable to ORO Technologies LLC or the Platform.
Users are responsible for loading, unloading, and securing equipment.
9. Good Faith Commitment
ORO may implement reasonable technological improvements aimed at enhancing accessibility and usability.
However:

10. Service Animals, Assistive Devices, and Accessibility Equipment
Passengers may use the Platform while accompanied by:
NO exceptions apply

service animals (including guide dogs)

assistive devices
-
mobility or medical equipment
in accordance with applicable laws.
a) Service Animals
Drivers remain solely responsible for complying with any applicable laws, regulations, or legal obligations relating to service animals in the jurisdiction where the transportation service is performed.
However, Users expressly acknowledge that:

Drivers are independent third parties;
-
ORO does NOT enforce Driver compliance in real time;
-
ORO does NOT guarantee ride acceptance or completion.
Enforcement of service-animal obligations remains subject to applicable law and individual Driver compliance.
b) Emotional Support Animals (ESA)
Passengers acknowledge that:

Emotional Support Animals (ESAs) are NOT recognized as service animals in all jurisdictions
Therefore:
👉 Drivers may legally decline trips involving ESAs where permitted by applicable law, without liability to ORO.
c) User Responsibility
Passengers traveling with animals or equipment must:

inform the Driver in advance when reasonably possible

ensure proper control and handling of animals
-
prevent damage or contamination of vehicles
Users remain fully responsible for:
-
any damages caused
-
cleaning or sanitation costs
-
incidents involving animals or equipment
d) Assistive Devices and Equipment
Passengers may travel with:

wheelchairs
-
walkers
-
mobility aids
-
medical equipment
However:
-
ORO does NOT guarantee vehicle compatibility
-
Drivers are NOT obligated to provide physical assistance unless otherwise expressly required by mandatory applicable law

Users are responsible for loading, unloading, and securing equipment
e) Limitation of Liability
To the maximum extent permitted by law, ORO shall NOT be liable for:

refusal of service by Drivers
-
allergic reactions or sensitivities
-
damages caused by animals or equipment
-
incompatibility with vehicles
-
injuries related to loading, unloading, or transport
f) Fraud and Misrepresentation
Misrepresenting a pet as a service animal, or abusing accessibility protections, may result in:
-
immediate account suspension
-
permanent ban from the Platform
-
legal action, including claims for damages where applicable
g) Accessible Vehicle Availability
ORO does not represent, warrant, or guarantee the availability of wheelchair-accessible vehicles, specialized mobility vehicles, disability-adapted vehicles, or transportation providers possessing accessibility-specific equipment in any jurisdiction, market, region, or geographic area.
11. Regulatory Compliance Disclaimer
ORO operates as a technology platform and does not itself provide transportation services.
Nothing in this Policy shall be interpreted as:

creating a transportation obligation
-
guaranteeing regulatory compliance by Drivers
-
establishing an employment or agency relationship
11-A. NO SPECIAL DUTY OF CARE OR CUSTODIAL RELATIONSHIP
Nothing contained within this Policy, the Platform, or any accessibility-related functionality shall be interpreted as creating:

a custodial relationship;
-
a fiduciary obligation;
-
a medical duty of care;
-
a caregiving obligation;
-
a transportation supervision obligation;
-
a special relationship imposing heightened legal duties;
-
a continuous monitoring obligation;
-
a rescue obligation.
ORO provides exclusively technological intermediation services and optional accessibility-support functionalities within the limitations of commercially reasonable software infrastructure.
All decisions regarding transportation suitability, medical supervision, accessibility needs, and personal safety remain exclusively the responsibility of the User and the independent third-party provider.
12. Policy Integration
This Policy is integrated into and governed by:

-
the Voice, Accessibility & Emergency Policy (ORO Safe-Voice)

all other incorporated policies
In the event of conflict, the Terms and Conditions shall prevail.

Continued access to, interaction with, registration on, or use of the Platform constitutes legally binding acknowledgment, acceptance, and incorporation of all applicable policies, limitations, disclaimers, technological conditions, liability restrictions, and future modifications to the maximum extent permitted under applicable law.
AGREEMENT ACCEPTANCE CLAUSE
(APPLICABLE TO ALL USERS AND TYPES OF TRANSPORTATION) – UNITED STATES
ORO TECHNOLOGIES LLC – GLOBAL HOLDING
ACCEPTANCE OF TERMS AND CONDITIONS
By registering, accessing, or using the ORO Platform, whether as a driver, courier, passenger, customer, corporate user, provider, or any other type of user, you expressly represent, warrant, and agree that you have read, understood, and fully accepted these Terms and Conditions, which constitute a legally binding agreement.
These Terms include, without limitation:

Personal data protection policies in accordance with applicable United States laws, including but not limited to the California Consumer Privacy Act (CCPA), Federal Trade Commission Act (FTC Act), Electronic Communications Privacy Act (ECPA), Florida Information Protection Act (FIPA), and other applicable federal and state regulations;

Conditions related to platform use, technological intermediation, payment processing, and overall service operation;
-
Binding individual arbitration under the Federal Arbitration Act (FAA), Title 9 of the United States Code, in accordance with JAMS or American Arbitration Association (AAA) rules;
-
An express waiver of class actions, collective claims, or representative proceedings to the fullest extent permitted by law.
INTERMEDIARY NATURE
You acknowledge and agree that ORO TECHNOLOGIES LLC operates solely as a technology-based intermediary platform, and that all services are provided by independent third parties acting at their own risk and responsibility.
No employment, agency, partnership, or joint venture relationship exists between ORO TECHNOLOGIES LLC and such third parties.
S.O.S. SAFETY FEATURE AND DATA USE
To enhance user safety, the platform integrates a voice-first and accessibility-centered emergency S.O.S. feature.
By using this functionality, you expressly authorize ORO TECHNOLOGIES LLC to:

collect and process real-time geolocation data
-
use relevant personal and technical data
-
share such data with authorized third parties
exclusively for:
-
activating emergency protocols
-
contacting contracted private security providers
-
coordinating with competent authorities (police, EMS, fire departments, or equivalent)
-
protecting life, safety, and personal integrity
Such providers are independent third parties bound by strict confidentiality and legal compliance obligations.
🛑 TRANSPORTATION COVERAGE
This acceptance applies to all forms of transportation, present or future, including but not limited to:
motorcycles, cars, vans, trucks, bicycles, scooters, electric vehicles, vessels, aircraft, helicopters, drones, and any land, air, maritime, fluvial, or multimodal system.

Violation of these Terms may result in:

⚖️ LIMITATION OF LIABILITY

limitations or failures of the S.O.S. feature

delays or lack of response from authorities

misuse, fraud, or negligent use of the platform
The company operates under the principle of good faith (UCC §1-304) and applies reasonable compliance and security standards.
