1. PURPOSE, SCOPE, LEGAL STATUS AND CORPORATE APPLICATION
This Platform Availability, System Performance and Service Level Disclosure (the "Disclosure") establishes the global legal, operational, technological, compliance, accessibility, infrastructure, cybersecurity, continuity, performance, reliability, availability, risk-management, and limitation-of-liability framework governing the operation of the ORO Marketplace Platform operated by ORO TECHNOLOGIES LLC ("ORO," the "Company," or the "Platform").
This Disclosure applies globally to all users, passengers, drivers, couriers, merchants, independent service providers, accessibility users, elderly users, users with disabilities, business partners, technology partners, contractors, vendors, affiliates, subsidiaries, and any individual or entity interacting with the Platform.
This Disclosure forms an integral component of ORO's unified global legal, compliance, governance, privacy, accessibility, cybersecurity, voice-technology, emergency-response, risk-management, and operational-control framework and shall be interpreted together with:

Nothing contained in this Disclosure shall be interpreted as creating:
a guaranteed service level;
a guaranteed uptime commitment;
a guaranteed response time;
a guaranteed availability obligation;
a guaranteed accessibility outcome;
a guaranteed emergency response capability;
a guaranteed transportation outcome;
a guaranteed communication outcome;
or any contractual service-level agreement unless expressly provided through a separate written agreement executed by authorized representatives of ORO.
2. NATURE OF THE PLATFORM
ORO operates exclusively as a technology platform that facilitates interactions between independent users and independent third-party providers.
ORO is not:
a transportation company;
a logistics company;
a dispatch center;
a public safety agency;
an emergency-response provider;
a telecommunications provider;
a cloud-services provider;
an internet-service provider;
a mobile-device manufacturer;
or a provider of underlying telecommunications or infrastructure services upon which Platform functionality may depend.
Platform performance depends upon numerous independent systems, technologies, providers, networks, and operational conditions beyond ORO's direct control.
3. NO GUARANTEE OF CONTINUOUS AVAILABILITY
The Platform, including all voice-enabled functionalities, accessibility features, communication tools, safety systems, S.O.S. functionalities, artificial intelligence systems, geolocation services, payment services, account-management tools, and related technological services, is provided on an "AS IS," "AS AVAILABLE," and "COMMERCIALLY REASONABLE EFFORTS" basis.
ORO does not warrant, represent, or guarantee that the Platform will be:
continuously available;
uninterrupted;
error-free;
delay-free;
free from downtime;
free from maintenance interruptions;
free from technical failures;
or available at all times.
Users expressly acknowledge that temporary interruptions, degradations, limitations, delays, outages, and service disruptions are inherent characteristics of modern digital platforms.
4. PLATFORM DEPENDENCIES AND INFRASTRUCTURE LIMITATIONS
Platform availability depends upon complex technological ecosystems involving independent third-party systems and infrastructure.
Such dependencies may include:
cloud-computing providers;
hosting providers;
telecommunications carriers;
mobile-network operators;
internet-service providers;
data centers;
mapping providers;
GPS providers;
payment processors;
identity-verification providers;
security-service providers;
voice-recognition providers;
artificial-intelligence providers;
accessibility technology providers;
operating-system providers;
mobile-device manufacturers;
application-store operators;
and other third-party infrastructure providers.
Failures, interruptions, degradations, delays, modifications, restrictions, or outages affecting any such third-party systems may impact Platform availability.
ORO does not control and cannot guarantee the performance of independent third-party infrastructure.
5. VOICE TECHNOLOGY PERFORMANCE DISCLOSURE
Because ORO operates through a voice-first accessibility model, Platform functionality depends significantly upon voice-processing technologies.
Users expressly acknowledge that voice systems may experience:
recognition errors;
transcription errors;
speech-processing delays;
language-processing limitations;
accent-recognition limitations;
accessibility-related processing limitations;
artificial-intelligence limitations;
microphone-related issues;
environmental interference;
background-noise interference;
connectivity-related failures;
and other technological limitations.
ORO does not guarantee that voice commands will always be recognized, interpreted, processed, executed, transmitted, or completed successfully.
Voice-based functionality remains inherently dependent upon multiple technical variables outside ORO's direct control.

6. ACCESSIBILITY TECHNOLOGY AVAILABILITY DISCLOSURE
ORO is committed to promoting accessibility and digital inclusion through commercially reasonable technological measures.
However, accessibility-related features remain subject to operational limitations.
Accessibility functionality may vary depending upon:
device type;
operating-system version;
hardware specifications;
network quality;
regional infrastructure;
language support;
assistive technology compatibility;
voice-processing capabilities;
third-party software interactions;
and other technological factors.
ORO does not guarantee that accessibility-related features will operate identically across all jurisdictions, devices, users, operating systems, accessibility technologies, or usage environments.
7. SYSTEM PERFORMANCE VARIABILITY
Platform performance may vary based upon factors including:
user location;
network conditions;
internet connectivity;
device performance;
device age;
software configuration;
application version;
regional infrastructure conditions;
system demand levels;
third-party service availability;
voice-processing requirements;
AI-processing requirements;
and numerous other operational variables.
Performance metrics observed by one user may differ substantially from those experienced by another user.
Accordingly, ORO does not guarantee uniform Platform performance across all users, locations, devices, or circumstances.
8. MAINTENANCE, UPDATES AND SYSTEM CHANGES
ORO may periodically perform:
maintenance activities;
security updates;
software upgrades;
accessibility improvements;
voice-system modifications;
artificial-intelligence updates;
database maintenance;
infrastructure migrations;
compliance-related modifications;
and other operational changes.
Such activities may result in temporary interruptions, degraded functionality, delayed responses, limited accessibility, feature unavailability, or temporary service disruptions.
ORO reserves the unrestricted right to implement such changes at any time when deemed reasonably necessary for business, compliance, operational, security, accessibility, or technological purposes.
9. NO GUARANTEED RESPONSE TIMES
ORO does not guarantee:
application response times;
voice-processing times;
customer-support response times;
S.O.S. response times;
provider acceptance times;
trip-matching times;
communication-delivery times;
notification-delivery times;
payment-processing times;
or any other operational timing metric.
All timing estimates presented through the Platform are informational estimates only and may vary significantly.
10. S.O.S. FUNCTIONALITY AND EMERGENCY SYSTEM AVAILABILITY LIMITATIONS
Users expressly acknowledge that S.O.S. functionality is dependent upon multiple independent technological systems.
The availability and operation of S.O.S. features may depend upon:
internet connectivity;
device functionality;
voice-recognition performance;
location services;
telecommunications infrastructure;
third-party monitoring systems;
security-service providers;
external websites;
governmental infrastructure;
and other independent systems.
Where available, S.O.S. alerts may be transmitted to independent third-party security providers operating under separate legal and operational frameworks.
Such third parties may independently communicate with emergency responders or law-enforcement agencies.
ORO does not guarantee:
successful alert transmission;
continuous monitoring;
emergency response;
law-enforcement intervention;
medical assistance;
third-party availability;
or successful emergency outcomes.
11. NO SERVICE LEVEL AGREEMENT
Unless expressly provided through a separate written agreement signed by authorized representatives of ORO, nothing within the Platform, website, application, marketing materials, onboarding materials, support documentation, accessibility disclosures, or communications shall be interpreted as creating a Service Level Agreement ("SLA").
No user shall acquire any right to:
minimum uptime levels;
minimum performance standards;
guaranteed accessibility levels;
guaranteed feature availability;
guaranteed infrastructure redundancy;
guaranteed processing speeds;
or any similar performance commitment.
12-A. NO GUARANTEE OF CONTINUOUS OR UNINTERRUPTED OPERATION
The User expressly acknowledges and agrees that modern digital platforms, cloud-based infrastructures, telecommunications systems, geolocation technologies, voice-processing systems, artificial intelligence technologies, accessibility tools, emergency-related functionalities, mobile operating systems, internet services, and third-party technology environments are inherently subject to interruptions, degradations, latency, failures, maintenance activities, and operational limitations.
Accordingly, ORO does not represent, warrant, or guarantee uninterrupted availability, continuous operation, fault-free functionality, constant accessibility, uninterrupted connectivity, uninterrupted voice processing, uninterrupted geolocation accuracy, uninterrupted communication capabilities, uninterrupted S.O.S. functionality, or uninterrupted access to any Platform feature, service, system, infrastructure component, or operational process.
Temporary interruptions, performance degradation, latency, reduced functionality, feature unavailability, maintenance activities, software failures, hardware failures, infrastructure outages, cloud-service disruptions, telecommunications interruptions, operating-system limitations, third-party service failures, accessibility-feature interruptions, or emergency-feature limitations shall not constitute:
a breach of contract;
a service-level guarantee violation;
a failure to provide transportation services;
a failure to provide emergency services;
a failure to provide accessibility accommodations;
or any basis for liability beyond that required under applicable law.
The User accepts all risks associated with the inherent limitations of digital technology environments.
12. SUSPENSION, RESTRICTION AND TEMPORARY UNAVAILABILITY
ORO reserves the unrestricted right to suspend, restrict, limit, disable, modify, interrupt, or discontinue access to any portion of the Platform where reasonably necessary for:
security purposes;
fraud prevention;
regulatory compliance;
legal compliance;
accessibility improvements;
system maintenance;
risk management;
cybersecurity protection;
operational stability;
or business continuity objectives.
Such actions may occur without prior notice where permitted by applicable law.
13. BUSINESS CONTINUITY AND DISASTER RECOVERY LIMITATIONS
ORO may maintain commercially reasonable business-continuity, disaster-recovery, redundancy, cybersecurity, and resilience measures.
However, no continuity program can eliminate all operational risks.
Users acknowledge that extraordinary events may impair Platform operations despite the existence of continuity measures.
Accordingly, ORO does not guarantee uninterrupted service availability following:
cybersecurity incidents;
infrastructure failures;
natural disasters;
telecommunications outages;
governmental actions;
public emergencies;
force majeure events;
third-party system failures;
or other extraordinary circumstances.
13-A. NO SERVICE LEVEL AGREEMENT (NO SLA)
Unless expressly provided in a separate written enterprise agreement executed by an authorized officer of ORO TECHNOLOGIES LLC, the Platform is not provided subject to any Service Level Agreement ("SLA").
No statement contained within:
marketing materials;
support documentation;
accessibility disclosures;
help-center content;
website materials;
training materials;
community communications;
voice-guidance systems;
or public statements
shall create any contractual obligation regarding:
minimum uptime;
response times;
processing times;
availability levels;
performance thresholds;
voice-recognition accuracy;
accessibility performance;
S.O.S. response times;
security monitoring;
incident response times;
or operational continuity metrics.
The absence of a specific SLA shall not be interpreted as a failure of service, breach of contract, negligence, warranty, representation, or guarantee.
All Platform services remain subject to the operational limitations described throughout the ORO legal ecosystem.
14. NO RELIANCE FOR CRITICAL OR LIFE-DEPENDENT FUNCTIONS
The Platform is not designed, certified, marketed, or intended as a life-critical system.
Users must not rely exclusively upon the Platform for:
medical monitoring;
emergency communications;
personal safety;
caregiving functions;
continuous supervision;
life-support functions;
public safety services;
emergency dispatch services;
or other critical functions where interruption may create elevated risks.
Independent alternative communication and emergency-response methods should always be maintained.
15. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, ORO TECHNOLOGIES LLC, its affiliates, subsidiaries, officers, directors, employees, contractors, licensors, vendors, technology partners, infrastructure providers, service providers, and representatives shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, statutory, enhanced, or similar damages arising from or related to:
downtime;
service interruptions;
performance degradation;
voice-processing failures;
accessibility-related interruptions;
telecommunications failures;
internet outages;
third-party system failures;
cloud-service interruptions;
infrastructure limitations;
maintenance activities;
service unavailability;
S.O.S. limitations;
processing delays;
or technological limitations inherent to digital platforms.
Users expressly acknowledge that Platform use occurs at their own risk.
15-A. USER RESPONSIBILITY FOR ALTERNATIVE COMMUNICATION METHODS
The User expressly acknowledges that no digital platform can guarantee continuous access to communications, transportation coordination systems, accessibility features, emergency-related functionalities, voice-recognition technologies, mobile applications, internet connectivity, telecommunications infrastructure, or third-party systems.
Accordingly, Users remain solely responsible for maintaining reasonable alternative communication methods appropriate to their circumstances, including where necessary:
telephone access;
internet access;
emergency contact methods;
caregiver communications;
medical communication channels;
public emergency contact systems;
and other independent communication resources.
Users must not rely exclusively upon the Platform for personal safety, emergency communications, accessibility-related assistance, transportation coordination, supervision needs, medical situations, or urgent communications.
To the maximum extent permitted by law, ORO shall not be liable for losses arising from a User's failure to maintain independent communication alternatives.
16. CORPORATE DISCRETION AND FUTURE MODIFICATIONS
ORO reserves the unrestricted right to modify, replace, discontinue, suspend, supplement, redesign, restrict, update, migrate, relocate, or remove any Platform feature, voice functionality, accessibility service, artificial-intelligence capability, communication tool, operational process, infrastructure component, safety feature, or technological service at any time.
Continued use of the Platform constitutes acceptance of such modifications.
17. GLOBAL LEGAL INTEGRATION NOTICE
This Platform Availability, System Performance and Service Level Disclosure forms part of the unified global legal, compliance, privacy, accessibility, cybersecurity, safety, operational, governance, risk-management, and dispute-resolution architecture governing the ORO Marketplace Platform operated by ORO TECHNOLOGIES LLC.
This Disclosure shall be interpreted together with all applicable Terms, Policies, Frameworks, Annexes, Compliance Standards, Accessibility Policies, Voice Technology Policies, Privacy Notices, Safety Frameworks, Independent Provider Disclosures, Arbitration Agreements, and future amendments published by ORO.
Continued access to, registration on, interaction with, or use of the Platform constitutes legally binding acknowledgment and acceptance of this Disclosure and all related legal frameworks to the maximum extent permitted under applicable law.
