Legal Process & Third-Party Data Request Policy

These guidelines are intended to inform third parties, including private individuals, civil litigants, criminal defendants, and their legal representatives, about the legal process required to request information from Oro Technologies LLC (“Oro”).

These guidelines are provided for informational purposes only and may be modified at any time without prior notice.

1. About Oro

Oro Technologies LLC is a technology company that develops and operates digital platforms connecting users with independent third-party service providers, including:

  • Drivers

  • Delivery personnel

  • Merchants

  • Logistics operators

Oro does not directly provide transportation, delivery, or logistics services. Oro acts solely as a technology intermediary platform.

Oro Technologies LLC collects, processes, transfers, and stores data strictly in accordance with its Privacy Policy, Terms and Conditions, applicable data protection laws, and operational security requirements.

Oro operates exclusively as a technology intermediary platform and does not assume responsibility for the independent actions, operations, or conduct of third-party service providers, including emergency response or security partners.

2. Service of Legal Documents (United States)

Oro Technologies LLC accepts formal service of legal process exclusively within the United States, through its registered agent or official address.

Legal documents include, but are not limited to:

  • Subpoenas

  • Complaints

  • Summons

  • Court Orders

Acceptance of legal process shall not be construed as a waiver of any rights, defenses, jurisdictional objections, or procedural protections available to Oro Technologies LLC under applicable law.

3. International Requests

For requests originating outside the United States:

  • They must comply with applicable local and international laws

  • They may require involvement of local Oro operators, partners, or affiliates

  • They must follow the civil procedural rules of the relevant jurisdiction

  • Where applicable, contractual agreements will prevail over these guidelines

3.1 JURISDICTIONAL LIMITATIONS AND CROSS-BORDER LEGAL PROCESS

ORO Technologies LLC is organized under the laws of the United States and processes requests in accordance with applicable jurisdictional requirements, international legal obligations, and available procedural mechanisms.

The Company reserves the right to require that foreign requests be submitted through:

applicable mutual legal assistance procedures;

letters rogatory;

international cooperation mechanisms;

recognized treaty frameworks;

or other legally authorized cross-border processes.

Nothing in this Policy shall be interpreted as requiring ORO to recognize, enforce, honor, or respond to foreign legal requests that are unenforceable, inconsistent with applicable law, jurisdictionally defective, or incompatible with legal obligations governing the Company.

4. Requirements for Data Requests

Oro will only disclose user information when legally required and upon receipt of valid legal process.

Oro may only process or disclose data obtained from third-party integrations, including safety, voice, or emergency-response systems, to the extent such data is lawfully provided, technically available, and subject to applicable contractual and legal limitations imposed by third-party providers.

Oro does not guarantee real-time access, accuracy, or completeness of data originating from independent third-party systems.

For third-party requests (non-governmental), Oro generally requires:

  • A valid subpoena, court order, or legally binding request

  • Proper legal service in accordance with applicable law

5. Request Standards

All data requests must be:

  • Specific and narrowly tailored

  • Based on a clearly defined time period

  • Supported by a valid legal basis

Requests must include:

  • A unique user identifier (email address, phone number, or account ID)

  • A clear description of the data requested

  • The relevant timeframe

  • Full contact information of the requesting party

Oro reserves the right to reject, challenge, or refuse requests that are:

  • Overly broad

  • Vague or unclear

  • Legally insufficient

6. Data Disclosure Policy

Where legally required, Oro will only disclose data that can be reasonably located and retrieved.

Oro:

  • Does not guarantee data availability

  • Does not guarantee completeness or specific formatting

  • May limit disclosure based on proportionality and privacy principles

6.1 DATA AVAILABILITY, RETENTION AND TECHNICAL LIMITATIONS

ORO Technologies LLC discloses only information that is reasonably available, legally retrievable, and maintained within its operational systems at the time a valid legal request is processed.

The Company does not guarantee that requested information:

remains available;

has been retained;

can be recovered;

exists in the requested format;

or is capable of being produced through commercially reasonable efforts.

Data may be subject to:

retention limitations;

deletion schedules;

anonymization processes;

security controls;

system migrations;

technical failures;

third-party infrastructure dependencies;

or legal preservation restrictions.

Nothing in this Policy shall be interpreted as creating any obligation to reconstruct, recover, recreate, restore, or generate information that is unavailable, deleted, anonymized, encrypted, corrupted, expired, or otherwise inaccessible.

7. Independent Contractor Status

Drivers, delivery personnel, and logistics operators using the Oro platform are independent contractors.

They are not employees, agents, or representatives of Oro Technologies LLC.

Accordingly:

  • Oro does not maintain employment records except where such records are required by applicable law or regulatory compliance obligations.

  • Oro does not provide employment verification

  • Oro does not control the direct provision of services

7.1 NO AGENCY OR REPRESENTATIVE RELATIONSHIP

Nothing within the Platform, any communication, transaction, service request, branding structure, software environment, accessibility feature, safety tool, payment flow, or commercial interaction shall be interpreted as creating:

an agency relationship;

an employment relationship;

a fiduciary duty;

a representative capacity;

a partnership;

a joint venture;

or any authority for one party to bind another.

All service providers remain solely responsible for their own conduct, representations, services, legal compliance, insurance obligations, licensing requirements, and operational decisions.

8. User Responsibility

Users are encouraged to access their own data directly through the platform before submitting legal requests.

Typically, users can access:

  • Trip history

  • Payment information

  • Account details

9. Emergency Requests

Oro does not respond to emergency requests from private parties.

In case of an emergency, individuals must contact:

  • Local law enforcement authorities

  • Emergency services (e.g., 911 or local equivalent)

9.1 NO EMERGENCY RESPONSE OBLIGATION

ORO Technologies LLC is not an emergency service provider, public safety answering point (PSAP), law enforcement agency, medical provider, security company, rescue organization, crisis-response entity, or governmental authority.

The existence of accessibility tools, voice technologies, emergency-related functionalities, safety systems, communication channels, or SOS features shall not create any duty to:

monitor emergencies;

dispatch assistance;

contact authorities;

coordinate rescues;

provide medical assistance;

provide security services;

or intervene in emergency situations.

Any emergency-related functionality is provided solely as a supplemental technology feature and may depend on independent third-party infrastructure beyond ORO's control.

10. Reservation of Rights

Oro reserves the right to:

  • Object to or challenge any legal request

  • Require proper jurisdiction and legal authority

  • Protect user data in accordance with applicable laws and regulations

10.1 THIRD-PARTY SECURITY, EMERGENCY AND DATA LIMITATION DISCLAIMER

Oro Technologies LLC may facilitate communication between users and independent third-party security providers, emergency coordinators, or response entities through voice-based or application-based SOS functionalities.

Users acknowledge and agree that:

Oro does not operate emergency services, dispatch systems, or law enforcement functions.

All emergency response actions are executed exclusively by independent third-party providers or competent public authorities.

Oro does not control, guarantee, or assume responsibility for response times, operational decisions, or outcomes resulting from third-party interventions.

Any data transmitted through SOS or safety features is processed solely as a communication facilitation mechanism and remains subject to the operational autonomy and policies of third-party service providers.

10.2 THIRD-PARTY PLATFORM AND INFRASTRUCTURE DEPENDENCY

Certain information potentially responsive to a legal request may originate from, be processed through, stored by, or depend upon independent third-party systems, including but not limited to:

cloud service providers;

telecommunications providers;

mapping and geolocation providers;

payment processors;

voice-processing vendors;

AI infrastructure providers;

security providers;

and emergency communication partners.

ORO does not own, control, or guarantee the availability, retention, accessibility, integrity, or recoverability of information maintained by such third parties.

The Company shall not be responsible for any delay, limitation, inaccuracy, deletion, unavailability, corruption, or inability to produce information resulting from third-party systems or infrastructure outside ORO's reasonable control.

11. Limitation of Liability

Oro shall not be liable for:

  • The use or misuse of disclosed information by third parties

  • Misinterpretation of the data provided

  • Any decisions or actions taken based on such information

11.1 THIRD-PARTY DATA AND RELIANCE DISCLAIMER

ORO Technologies LLC shall not be responsible for the accuracy, completeness, reliability, legality, authenticity, availability, or evidentiary value of information obtained from:

users;

service providers;

government authorities;

payment processors;

telecommunications providers;

mapping services;

security vendors;

emergency coordination entities;

voice-processing systems;

AI providers;

or any other third-party source.

Any party relying upon information disclosed by ORO does so at its own risk and remains solely responsible for verifying the accuracy, sufficiency, and legal relevance of such information.

11.2 NO DUTY TO PRESERVE EVIDENCE

Except where expressly required by applicable law or valid preservation obligations, ORO Technologies LLC assumes no affirmative duty to preserve evidence, maintain records indefinitely, create investigative files, monitor user activity, or retain information for the benefit of private parties.

The absence, deletion, expiration, corruption, anonymization, or unavailability of information shall not create any presumption of liability, negligence, spoliation, evidentiary misconduct, or wrongdoing on the part of ORO Technologies LLC.

11.3 GOVERNING LANGUAGE

This Policy may be translated into multiple languages for informational and accessibility purposes.

To the maximum extent permitted by applicable law, the English-language version shall govern and prevail in the event of any conflict, discrepancy, inconsistency, ambiguity, omission, or translation error.

All translations are provided solely as a convenience and shall not modify, expand, restrict, or supersede the legal effect of the official English-language version.

11.4 NO WAIVER OF LEGAL RIGHTS OR DEFENSES

Compliance with any legal request, disclosure decision, preservation request, objection, communication, review process, or cooperation effort shall not constitute:

an admission of liability;

an admission of jurisdiction;

a waiver of privilege;

a waiver of confidentiality protections;

a waiver of procedural rights;

a waiver of substantive defenses;

or a waiver of any legal remedy available to ORO Technologies LLC.

All rights, objections, privileges, immunities, defenses, and protections are expressly reserved.

12. Updates

This policy may be modified, updated, or replaced at any time without prior notice.

GLOBAL LEGAL INTEGRATION NOTICE

These Terms form part of the unified global legal framework governing the ORO Marketplace Platform, including the Privacy Policy, Accessibility & Voice Policy, Community Guidelines, Safety Framework, Refund Policy, and all related legal disclosures published by Oro Technologies LLC.

Continued access to or use of the Platform constitutes legally binding acceptance of all applicable policies and future updates.
